This appeal involves a conviction following a guilty plea to a charge of committing homicide by reckless conduct. The conviction grows out of an incident on August 4, 1968, wherein the plaintiff in error, Bernard Calvin Salters, hereinafter defendant, was charged with first-degree murder contrary to sec. 940.01, Stats., as the result of a shooting in a tavern in the city of Milwaukee. Following a preliminary hearing in county court, defendant entered a plea of not guilty in the circuit court for Milwaukee county, Hon. John L. Coffey presiding. On October 17, 1968, the assistant district attorney moved the court to reduce the charge to homicide by reckless conduct. Defendant then entered a plea of guilty to the amended complaint. After ascertaining the voluntariness of the plea, the trial court stated: "The said guilty plea is accepted and received by the court."
