On April 4, 1977, at about 5:00 a.m., a collision occurred between a truck-tractor with pole trailer driven by appellant Wyman Lee Scroggins, employee of appellant P.T. & E. Company and a pick-up truck driven by James F. Beasley near the intersection of Highway 84 and U.S. Highway 59 in Tenaha, Shelby County, Texas. The collision resulted in the death of James F. Beasley.
